SC to hear treason petitions against Musharraf

(eNews.pk) - ISLAMABAD: The Supreme Court of Pakistan will resume hearing identical petitions, seeking directives to initiate high treason case against former military dictator Pervez Musharraf to subvert the Constitution and imposing a state of emergency today (Monday).




A three-judge bench comprising Justice Jawad S. Khawaja, Justice Khilji Arif Hussain and Justice Ejaz Afzal Khan would take the case. The federal government will present its response on item you are.
During the last day of the trial, additional law secretary told the court that the Minister of the Interior was authorized to initiate high treason case and notification to this effect was issued in 1994.
A division bench of the apex court consisting of Justice Jawad S. Khawaja and Justice Khilji Arif Hussain had issued notice to the Secretary of the Interior, looking for an explanation of what action was taken following the resolution of the Senate who sought action against the former president and former army chief Gen (retd) Pervez Musharraf.

اسلام آباد…سابق صدر جنرل ریٹائرڈ پرویز مشرف کے خلاف غداری کا مقدمہ چلانے کی درخواستوں پر سماعت آج ہو گی۔ وفاقی حکومت آرٹیکل سکس پرآج اپنا موقف عدالت کو بتا ئے گی، کیس کی سماعت جسٹس جواد ایس خواجہ اور جسٹس خلجی عارف کی سربراہی میں 2رکنی بنچ کررہاہے۔ گزشتہ سماعت پر ایڈیشنل سیکریٹری قانون نے انکشاف کیا کہ قانون کے مطابق سنگین غداری کے مقدمے کی کارروائی شروع کرنے کا اختیار سیکریٹری داخلہ کے پاس ہے، یہ نوٹیفکیشن 1994ء میں جاری کیا گیا تھا۔ جس پر عدالت نے سیکریٹری داخلہ کو نوٹس جاری کرتے ہوئے حکم دیا ہے کہ وہ دستاویزی شواہد دیں کہ سینیٹ کی قرارداد کے بعد پرویز مشرف کے حوالے سے کیا کارروائی کی گئی ؟ کیس کی سماعت آج ہو گی۔اس سے پہلے 19 اپریل کو سینیٹ کے اجلاس میں پرویز مشرف کے خلاف آرٹیکل سکس کے تحت یعنی غداری کی کارروائی کرنے کی ایک قرارداد بھی منظور کر لی گئی ہے۔ ادھر نگراں وزیراطلاعات عارف نظامی نے کہا تھا کہ آرٹیکل سکس کامعاملہ ابھی حکومت کے پاس نہیں آیا،اس بارے میں وفاق کا موقف آج یعنی پیر کے روز تک عدالت میں جمع کرا دیا جائے گا۔ عدالت کے فیصلوں پران کی روح کے مطابق عمل کیاجائیگا۔
