President’s role minimal in judges appointment: SC

(eNews.pk) - ISLAMABAD: The Supreme Court of Pakistan (SC), while announcing its verdict in the case of appointment of judges ruled that the role of the president to appoint judges is nominal and judicial commission is responsible for determining the age of judges, Geo news reported Thursday.




A five-judge bench headed by Justice Khilji Arif Hussain and Justice Tariq Parvez composed, Justice Ejaz Afzal Khan, Justice Gulzar Ahmed and Justice Sheikh Azmat Saeed had reserved its judgment on 21 December 2012 presidential reference seeking advice regarding appointment of judges.
In his 102-page order, the SC said that the president's role in the appointment of senior judges is nominal and that a judicial commission is responsible for appointing senior judges in accordance with the Constitution.
The order also that the president is obliged to follow the advice of the prime minister in the appointment of chief election commissioner, the interim prime minister, president Public Service Commission and the head of the armed forces.

اسلام آباد…سپریم کورٹ نے ججز تقرری کیس کا فیصلہ سناتے ہوئے قرار دیا ہے کہ ججز کی تقرری کے معاملے پر صدر کا کردار برائے نام ہے، سینیارٹی طے کرنے کا اختیار آئین نے جوڈیشل کمیشن کو دیا ہے۔ جسٹس خلجی عارف کی سربراہی میں سپریم کورٹ کے پانچ رکنی لارجر بنچ نے مقدمے کی سماعت کی ۔ فیصلے میں کہا گیا ہے کہ چیف الیکشن کمشنر، نگراں وزیراعظم،چیئرمین پبلک سروس کمیشن اورمسلح افواج کے سربراہ کے تقرر میں صدر وزیراعظم کے مشورے کا پابند ہے۔ عدالت نے جسٹس انور کاسی کی بطور چیف جسٹس اسلام آباد ہائیکورٹ تعیناتی اکثریتی فیصلہ دیا ہے جبکہ جسٹس اعجاز نے اپنے اختلافی نوٹ میں کہا ہے کہ جسٹس ریاض کو اسلام آباد ہائیکورٹ کا چیف جسٹس بنانا چاہئے۔سپریم کورٹ کا فیصلہ 102 صفحات پر مشتمل ہے ۔ صدارتی ریفرنس پر عدالت نے 21دسمبر کو فیصلہ محفوظ کیا تھا۔ صدارتی ریفرنس میں ججز تقرری سے متعلق سوالات اٹھائے گئے تھے۔ صدارتی ریفرنس وزارت قانون کی جانب سے داخل کرایا گیا تھا جس میں آرٹیکل 186 کے تحت 13قانونی نکات پر سپریم کورٹ کی رائے طلب کی گئی تھی۔
