ISLAMABAD: The Chief Justice of Pakistan, Iftikhar Muhammad Chaudhry, has said that prices of Compressed Natural Gas (CNG) and gasoline can not be linked and called the CEOs of Sui Southern and Sui gas companies North Thursday.
The CJ issued these statements to know the prices for oil here on Wednesday.
The Supreme Court also expressed anger at the policy evaluation of prices of petroleum products and CNG on a weekly basis and have asked relevant data in this regard.
The Chief Justice, it seemed as if two companies were enjoying a monopoly in which decisions are made according to his own will. He said the unfair treatment meted out to the people will not be tolerated and warned that the court will have to issue some order tomorrow.
The CJ sought a response from the president of the Oil and Gas Regulatory Authority (OGRA) in that he had written to link the price of gasoline to CNG.
Justice Jawwad Khawaja said that if the consumer has been charged more than what is right, then that money will have to be returned.
For this OGRA Chairman Saeed Khan said that companies do not file an application to determine gas prices.
Justice Khawaja asked how OGRA would issue a notice to increase prices if this was the case and that the OGRA role should be to protect the consumer.
Pointing OGRA President, said: "If you evaluate the situation itself would conclude that the poor is getting no benefit (of this)."
Secretary Waqar Masood Oil informed the court that although it had been decided that CNG price is determined on a semester basis, the government (on the contrary) CNG prices linked to gasoline.

اسلام آباد…چیف جسٹس افتخار محمد چودھری نے پیٹرولیم مصنوعات کی قیمتوں کے مقدمے میں ریمارکس دیتے ہوئے کہا ہے کہ قانون کے تحت سی این جی کی قیمتوں کو پٹرول سے لنک نہیں کیا جا سکتا،سپریم کورٹ نے سوئی ناردرن اور سوئی سدرن کے ایم ڈیز کو کل طلب کرلیا،عدالت نے پیٹرولیم قیمتوں کے ہفتہ وار تعین کی پالیسی کے نتائج کی تفصیلات بھی طلب کرلیں ۔پیٹرولیم مصنوعات کی قیمتوں کے مقدمے کی سماعت کے دوران سپریم کورٹ نے پیٹرولیم مصنوعات اور سی این جی کی قیمتوں میں ہفتہ وار ردوبدل کی پالیسی پر برہمی کا اظہار کیا۔چیف جسٹس افتخارمحمد چودھری نے ریمارکس دیئے کہ دو کمپنیوں کی اجارہ داری ہے ، جو چاہتے ہیں کرتے ہیں، چیف جسٹس نے کہا کہ لوگوں کو خوار نہیں کرنے دیں گے، عدالت کو کل کوئی حکم جاری کرنا پڑے گا، چیف جسٹس نے چیئرمین اوگرا سے جواب طلب کرلیا کہ سی این جی کی قیمتیں پیٹرولیم سے لنک کرنے کا کس نے کہا، جسٹس جواد ایس خواجہ نے اپنے ریمارکس میں کہا کہ صارف سے بلا جواز پیسہ لیا گیا تو وہ واپس ہو گا،اس موقع پر چیئرمین اوگرا سعید خان نے کہا کہ گیس کی قیمتیں مقرر کرنے کے لیے کمپنیاں درخواست نہیں دیتیں،جسٹس جواد ایس خواجہ نے کہا کہ تو پھر آپ قیمتیں بڑھانے کا نوٹی فی کیشن کیسے کر دیتے ہیں، اوگرا کو تو صارف کا تحفظ کرنا ہے ، آپ خود غور کریں اس نتیجہ پر پہنچ جائیں گے کہ غریب کو فائدہ نہیں ہو رہا، سیکرٹیری پیٹرولیم وقار مسعود نے عدالت کو بتایا کہ سی این جی قیمتیں ہر چھ ماہ بعد مقرر کرنا طے ہوا تھا، حکومت نے پیٹرول کے ساتھ اسے منسلک کر دیا ،ہفتہ وار قیمتوں کے تعین سے صارف کو فائدہ ہو رہا ہے ،جس پر چیف جسٹس افتخار محمد چودھری نے کہا کہ عوام کا برا حال ہو گیا ہے ،جسٹس جواد ایس خواجہ نے ریمارکس دیئے کہ سیٹھ کی جیب سے 10 روپے نکلنے سے شائد اسے فرق نہ پڑے،حکومت جب غریب کی جیب پر ہاتھ ڈالے گی تو وہ اس کا استحصال ہو گا، انہوں نے کہا کہ عوام کا استحصال کرنے والوں کے خلاف سخت ایکشن لیں گے۔ چیف جسٹس نے چیئرمین اوگرا کی سرزنش کرتے ہوئے کہاکہ کیوں سارے مل کر عوام کو لوٹتے ہو،پارلیمنٹ کی قرارداد پر عمل نہیں ہوا،اوگرا والے صارفین کا نہیں لائسنس ہولڈرز کے مفاد کا تحفظ کرتی ہے،چیئرمین اوگرا نے کہاکہ قیمتوں کے ہفتہ وار تعین کا فیصلہ ای سی سی نے وزارت پٹرولیم کی سمری پر کیا،جسٹس جواد خواجہ نے کہاکہ اوگرا، حکومت کے ماتحت نہیں، یہ ریگولیٹر ہے، سی این جی قیمت 25 سے بڑھ کر 92 روپیہ فی کلو ہوگئی، پھر عدالت نے پٹرولیم پالیسی 2001ء طلب کرلی، چیف جسٹس نے کہاکہ کسی جھگی میں جا کر دیکھیں ، حقیقت واضح ہوجائے گی، سمجھ نہیں آتا کہ ہر ہفتہ کاسٹ آڈیٹنگ کیسے ہوجاتی ہے، گیس لائن لاسز کا بوجھ صارفین پر پڑتا ہے، سی این جی کو پیٹرول سے کیسے لنک کردیا ہے، اس پر ایک دو دن میں آرڈر دیں گے۔
