Dr Tahirul Qadri files petition in SC

(eNews.pk) - ISLAMABAD: Pakistan Awami Tehreek (PAT) Officer Dr Tahirul Qadri has filed a petition in the Supreme Court (SC), in search of the restructuring of the Election Commission of Pakistan (ECP).




Talking to media outside the headquarters of the apex court, Dr. Tahirul Qadri said Article 218 of the Constitution deals with ECP issues, which he said the ECP is reconstituted under Article 213.
He said the Constitution provides that the ECP was composed of five members.
Qadri said that according to the Constitution, 15 names would be submitted to Parliament before the appointment of members to ECP. The parliament hearing all 15 candidates under Article 213.
The Constitution limits congressional hearing before the appointment of the members of the commission, said.

اسلام آباد…پاکستان عوامی تحریک کے سربراہ طاہر القادری نے الیکشن کمیشن کی تشکیل نو کیلئے درخواست سپریم کورٹ میں جمع کرا دی۔درخواست جمع کرانے کے بعد سپریم کورٹ کے باہر میڈیا سے بات کرتے ہوئے علامہ طاہرالقادری نے کہا کہ الیکشن کمیشن کی دوبارہ تشکیل کیلئے آئین کے مطابق اقدامات کیے جائیں۔طاہرالقادری نے بتایا کہ پاکستان کے آئین میں آرٹیکل 218 الیکشن کمیشن کو ڈیل کرتا ہے، جوکہتا ہیک ہ 5ارکان پر مشتمل الیکشن کمیشن ہوگا، آرٹیکل 218 میں ہے کہ الیکشن کمیشن کی تشکیل آرٹیکل 213 کے تحت ہو گی،آرٹیکل 213 کے مطابق الیکشن کمیشن کے پانچوں ممبران کیلئے3،تین نام بھجوائے جائیں گے اور وہ نام پارلیمانی کمیٹی کے سامنے پیش کیے جائیں گے،آرٹیکل 213 کے تحت پارلیمنٹ ان تمام لوگوں کو بلا کر ان کی سماعت کرے گی۔طاہر القادری کا کہنا تھاکہ آئین کے مطابق اہل افراد کو الیکشن لڑنے کی اجازت دی جائے گی،یہ کیس چند دن میں نمٹ جائے گا، کمیشن کے ارکان کی دوبارہ تقرری میں 7 دن سے زائد نہیں لگیں گے،آئین نے پابند بنایا ہے کہ تقرری سے پہلے سماعت کی جائے،اگر پارلیمانی کمیٹی آئینی طریقہ کار اختیار کرے گی تو منظور ہو گا،سپریم کورٹ کا جو بھی فیصلہ ہوگا،منظور ہوگا۔
