Waheeda’s ineligibility order suspended

(eNews.pk) - HYDERABAD: The Sindh High Court Sukkar Bench Tuesday, suspended the disqualification order of Waheeda Shah by the five-member bench of the Election Commission.




The High Court has stopped the scheduled by-election on April 26 in Sindh constituency PS-53 of the provincial assembly.
The bench comprising of Justice Aqeel Abbasi and Justice Nisar Sheikh has passed this order on the constitutional petition of Waheeda Shah.
Following the incident of election staff thrashing by Waheeda Shah, the five-member bench of the Election Commission in a majority decision declaring Waheeda Shah ineligible for two years had ordered for holding fresh election in PS-53.
This order was challenged by Waheeda Shah through a petition, which came up for hearing by the SHC bench today.
Waheeda Shah’s counsel Haider Imam Rizvi pointed out the flaws in the Election Commission order.
After the initial hearing, SHC bench suspended the decision of the Election Commission and also stopped the holding of by-election scheduled for April 26.
The bench has issued notice to the Election Commission of Pakistan and others for May 15.

حيدرآباد… سندھ ہائي کورٹ سکھر کے بنچ نے وحيدہ شاہ کيس ميں اليکش کميشن کے پانچ رکني بنچ کا فيصلہ معطل کرتے ہوئے صوبائي اسمبلي کے حلقے پي ايس 53ميں26 اپريل کو ہونے والا ضمني انتخاب روک ديا ہے.جسٹس عقيل عباسي اور جسٹس نثار شيخ پر مشتمل بنچ نے يہ حکم وحيدہ شاہ کي آئيني درخواست پر جاري کيا. وحيدہ شاہ کي طرف سے ليکن عملے کي پٹائي کے واقعے کے بعد اليکشن کميشن کے پانچ رکني بنچ نے اکثريت رائے سے وحيدہ شاہ کو دو سال کے ليئے نااہل قرر ديتے وہئے پي ايس 53 مين اليکشن دوبارہ کرانے کا حکم ديا تھا. آج اس فيصلے کے خلاف وحيدہ شاہ کي درخواست کي سماعت ہوئي. انکے وکيل حيدر امام رضوي نے اليکشن کميشن کے فيصلے ميں خاميوں کي نشاندہي کي. ابتدائي سماعت کے بعد بنچ نے اليکشن کميشن کا فيصلہ معطل کرديا اور پي ايس 53 ميں 26 مئي کو ہونے والا ضمني انتخاب روک ديا ہے. بنچ نے اليکشن کميشن آف پاکستان اور ديگر کو 15 مئي کے ليئے نوٹس جاري کرديئے ہيں.
