Australia tobacco firms lose plain pack case

(eNews.pk) - SYDNEY: Global companies of snuff lose a "watershed" judicial recourse to the laws of Australia plain packaging for cigarettes on Wednesday in a health advocates closely watched case, said that impact worldwide.

The High Court of Australia ruled that the measures, forcing cigarettes and snuff products sold in containers monotonous, uniform, graphic health warnings on December 1 this year, did not violate the Constitution.

Four companies led by British American Tobacco (BAT) had challenged the law, saying it violated his intellectual property rights by prohibiting marks and trademarks of the packages, and was unconstitutional. But the court rejected the argument BAT, Japan Tobacco International, Imperial Tobacco and Philip Morris that the law represented "an acquisition of (your) property otherwise than in just words."

سڈني… آسٹريليا کي اعلي عدليہ نے سگريٹ کے پيکٹوں سے کمپنيوں کے نام ،ڈيزائن اور لوگوختم کرنے کے فيصلے کو برقرار رکھا ہے. آسٹريليا ميں حکومت نے سگريٹ کمپنيوں پر پابندي عائد کردي تھي کہ وہ سگريٹ کے پيکٹوں پر کسي بھي قسم کا لوگو يا برانڈ کا نام نہ ديں بلکہ تمام کمپنياں ايک ہي قسم کے گہرے سبز رنگ کے سادہ پيکٹ استعمال کريں، جس پر صرف سگريٹ نوشي کے مضر ہونے کي ہدايت درج ہو. ماہرين کے مطابق اس اقدام کا مقصد سگريٹ نوشي کي حوصلہ شکني کرنا ہے، کيونکہ خوش نما رنگ اور دلکش ڈيزائن نوجوانوں کو اپني جانب متوجہ کرتے ہيں. سگريٹ کمپنيوں نے حکومت کے فيصلے کے خلاف عدالت ميں اپيل کي تھي تاہم عدالت نے ان کي درخواست مسترد کردي ہے جس کے بعد اس سال دسمبر سے آسٹريليا ميں اس قانون کا نفاذ ہو جائے گا.
