حضورﷺ بطور قانون ساز

قانون معاشرے میں امن و امان برقرار رکھنے ، نظم و ضبط برقرار رکھنے اور معاشرے کے ممبروں کے حقوق اور فرائض کے مابین توازن قائم کرنے کا نام ہے۔ یہ وہ قانون ہے جو معاشرے کی بدنامی کو دور کرتا ہے۔ یہی وجہ ہے کہ جب سے لوگ دنیا میں آباد ہوئے ہم نے قوانین کا وجود دیکھا ہے۔

قرآن کریم میں اللہ تعالیٰ نے حضرت آدم علیہ السلام کے دونوں بیٹوں کے مابین ہونے والے تنازعہ کا تذکرہ کیا اور اس وقت کے موجودہ قانون کے مطابق اس تنازعہ کے حل کا بھی ذکر کیا۔ تب بھی ، یہ واقعہ قانون کے مستقل وجود کا ایک بہت بڑا ثبوت ہے۔

عام طور پر یہ قانون دو طریقوں سے تیار کیا گیا تھا۔ ایک یہ کہ لوگوں نے ایسے قانون نافذ کیے جو معاشرے کے اپنے حالات اور ضروریات کو مدنظر رکھتے ہیں اور پھر ان قوانین کو معاشرے میں لاگو کرتے ہیں۔ ہے کیونکہ قانون سازی کے اس طریقے سے ہی انسان اپنے ناقص عمل اور فہم کو استعمال کرتا ہے۔

لہذا بہت سی کوتاہیاں ہیں۔ لہذا ، اس طرح وضع کردہ قوانین میں بعد میں تبدیلیاں ناگزیر ہوجاتی ہیں۔ قانون سازی کا دوسرا طریقہ الہامی ہدایت ہے جو اللہ تعالیٰ نے اپنے انبیاء اکرام علیہم السلام کے توسط سے دی ہے۔ اس قانون سازی کے عمل میں ، اللہ تعالیٰ نے اپنے پیغمبروں کو کتابوں اور صحیفوں کی شکل میں ہدایت دی۔ ان ہدایات کے مطابق قتل ، چوری ، سود ، رشوت اور بدکاری سے منع کیا گیا اور مجرموں کی سزا مقرر کر دی گئی ۔

اللہ کی عطاء کردہ ہدایت کے پیش نظر ، شریعت میں آخری کلام رسول اکرم صلی اللہ علیہ وآلہ وسلم کا ہے ، اور خدا کے پیغامات اور ہدایات کو بنی نوع انسان تک پہنچانے کے لئے آخری نبی ہونے کی وجہ سے ، اُن کی نبوت و رسالت کا دائرہ بہت وسیع ہے۔ لہذا ، رسول اللہ صلی اللہ علیہ واٰلہ وسلم کے وضع کردہ تمام قوانین ایک بہت ہی جامع اور مکمل دستاویز ہیں۔ اس سلسلے میں ، یہ بات واضح ہے کہ جب قرآن کا تفصیلی مطالعہ کیا جائے تو معلوم ہوتا ہے کہ حضور صلی اللہ علیہ وسلم کا تعارف مختلف طریقوں سے کرایا گیا ہے، ان میں سے ایک قانون ساز کا کردار ہے ۔ آنحضرت صلی اللہ علیہ وسلم کا یہ مؤقف اتنا یقینی ہے کہ رب کائنات نے ہمیں رسول اللہ صلی اللہ علیہ وسلم کی تمام ہدایات اور اقوال کو قبول کرنے اور ان پر عمل کرنے کا حکم دیا ہے۔ لہذا ربانی کی ہدایت کا معنی یہ ہے: “’جو رسول (ﷺ) تمہیں دیں وہ لے لو اور جن سے منع فرمائیں، اُن سے رک جاؤ۔‘‘ (سورۂ حشر)

سورت الاعراف میں ارشاد ہے: ’’وہ اُن (انسانوں) کو نیک باتوں کا حکم دیتے ہیں اور بُری باتوں سے منع کرتے ہیں اور پاکیزہ چیزوں کو اُن پر حلال (کرتے ہیں اور گندی چیزوں کو اُن پر حرام قرار دیتے ہیں۔‘‘ (سورۂ اعراف

آنحضرت کا یہ درجہ اتنا اہم ہے کہ اس درجہ کی تردید کرنے والوں کے ایمان کی نفی کردی گئی ہے۔ لہذا ارشاد گرامی کا پفہوم ہے: ’’سو، آپؐ کے ربّ کی قسم! یہ مومن نہیں ہوسکتے، جب تک کہ آپؐ کو اپنے تمام معاملات میں حاکم تسلیم نہ کرلیں پھر جو فیصلے آپؐ ان میں کردیں، ان سے اپنے دل میں کسی طرح کی تنگی اور ناخوشی نہ پائیں اور فرماں برداری کے ساتھ قبول کرلیں۔‘‘ (سورۂ نساء)

نبی اکرم صلی اللہ علیہ وسلم نے صحابہ اکرام رضوان اللہ علیھم اجمٰعین حتٰی کہ اس وقت کے یہودیوں کے مابین تنازعات پر قانون ساز کی حیثیت سے ، اور ان فیصلوں پر عمل درآمد کرتے ہوئے آپﷺ نے ایسے اصول و ضوابط قائم کیے ۔ جو عصرِ حاضر کے لئے مشعلِ راہ ثابت ہوئے ہیں اور اب ایک باقاعدہ قانون کے طور پر پوری دنیا کی عدالتوں میں نافذ ہیں ۔ اس تناظر میں ، دو اصول بطور مثال دیئے گئے ہیں۔

نبی اکرم صلی اللہ علیہ وسلم نے فرمایا کہ یہ ثبوت پیش کرنا مدعی کی ذمہ داری ہے جب کہ کوئی ثبوت نہ ہونے کی صورت میں مدعا علیہ حلف اٹھاتا ہے۔ نبی اکرم صلی اللہ علیہ وسلم کے اس اصول نے آج ایک خاص مقام اختیار کیا ہے۔ اسی طرح ، ایک اصول یہ بھی بیان فرمایا ہے کہ کسی بھی شخص کو سزا نہیں دی جا سکتی جب تک اُس کی سماعت نہیں ہوتی ، یعنی سزا دینے سے پہلے انہیں اپنے دفاع کا موقع فراہم کیا جاتا ہے۔ قرآن پاک میں یہ اصول آدم اور ابلیس کی کہانی میں بھی دیکھا جاتا ہے۔ یہ واقعہ اس سے پہلے ہوا تھا کہ دنیا میں لوگوں کی آبادی تھی۔ جب ابلیس نے اللہ تعالی کے حکم کی نافرمانی کی اور حضرت آدم علیہ السلام کے سامنے سجدہ کرنے سے انکار کردیا تو اللہ تعالیٰ نے فورا ہی اسے سزا نہیں دی بلکہ پہلے اسے اپنے دفاع میں بولنے کا پورا موقع دیا ، اور پھر اسے سزا کے طور پر مردود قرار دیا ۔

نبی اکرم صلی اللہ علیہ وسلم نے قرآن کریم کی آیات کی تفسیر اور امت کی سہولت کے لئے اپنے رب کے عطا کردہ اعلی منصب کی بناء پر مختلف قوانین وضع فرمائے۔ وہ تمام قوانین جو انہوں نے قرآن حکیم کی شکل میں عطاء فرمائےاور جو کچھ انہوں نے اپنی احادیث کے ذریعہ عطاء فرمائے وہ سب کے سب تمام انسانوں خاص طور پر مسلمانوں کے لئے فائدہ مند اور کامیابی کا زِینہ ہیں ۔ اگر آج پاکستان میں نبی کریمﷺ کے عطاء کردہ قوانین کا نفاذ کیا جائے تو اس ملک کو موجودہ معاشی ، معاشرتی اور اخلاقی مسائل سے بچایا جاسکتا ہے۔

Law is the name of maintaining law and order in the society, maintaining discipline and striking a balance between the rights and duties of the members of the society. This is the law that removes the stigma of society. That is why we have seen the existence of laws since people settled in the world.

In the Holy Quran, Allah Almighty mentioned the dispute between the two sons of Adam (PBUH) and also resolved the dispute according to the existing law of the time. Even so, owning one is still beyond the reach of the average person.

In general, the law was drafted in two ways. One is that people have enacted laws that take into account the circumstances and needs of society and then apply those laws to society. This is because it is in this way of legislation that man uses his faulty actions and understanding.

So there are many shortcomings. Therefore, later changes in the rules formulated in this way become inevitable. The second method of legislation is the divine guidance which Allah Almighty has given through His Holy Prophets. In this legislative process, Allah Almighty guided His prophets in the form of books and scriptures. According to these instructions, murder, theft, usury, bribery and corruption were prohibited and the culprits were punished.

In view of the guidance given by Allah, the last word in the Shari’ah belongs to the Holy Prophet (PBUH), and as the last prophet to convey God’s messages and instructions to mankind, his prophecy and prophethood The scope is very wide. Therefore, all the laws enacted by the Prophet (peace be upon him) are a very comprehensive and complete document. In this regard, it is clear that a detailed study of the Qur’an reveals that the Prophet (peace be upon him) has been introduced in various ways, one of which is the role of the legislator. The position of the Prophet (peace be upon him) is so certain that the Lord of the Universe has commanded us to accept and follow all the instructions and sayings of the Prophet (peace be upon him). Therefore, the meaning of Rabbani’s guidance is:

“Take what the Messenger gives you and refrain from what He forbids you.” (Surat al-Hashr)

It is stated in Surat al-A’raf:

“They enjoin what is right and forbid what is wrong, and make lawful for them what is good and forbid what is bad for them.” (سورۂ اعراف)

This rank of the Prophet is so important that the faith of those who deny this rank has been denied. Therefore, the meaning of Irshad Grami is:

“So, by your Lord! They cannot be believers unless they accept you as the ruler in all their affairs, then they do not find any hardship or unhappiness in their hearts from the decisions you make in them and accept them with obedience. (سورۂ نساء)

The Holy Prophet (peace and blessings of Allaah be upon him) established such rules and regulations as a legislator on disputes between the Companions of the time, even among the Jews of that time, and in implementing these decisions. Which have proved to be a beacon for modern times and are now enforced in the courts of the world as a formal law. In this context, two principles are given as examples.

The Prophet (peace and blessings of Allah be upon him) said that it is the responsibility of the plaintiff to present this evidence while in the absence of any evidence the defendant takes an oath. This principle of the Holy Prophet (sws) has taken a special place today. Similarly, a principle is stated that no person can be punished unless he is heard, that is, he is given an opportunity to defend himself before being punished. This principle is also seen in the Quran in the story of Adam and Iblis. This happened before the world had a population. When Iblis disobeyed Allah’s command and refused to prostrate before Adam (peace be upon him), Allah did not immediately punish him but first gave him ample opportunity to speak in his defense, and then as a punishment. But rejected.

The Holy Prophet (sws) formulated various laws for the interpretation of the verses of the Holy Qur’an and for the convenience of the ummah on the basis of the high position given to him by his Lord. All the laws that he has given in the form of the Qur’an Al-Hakim and all that he has given through his hadiths are a stepping stone to the benefit and success of all human beings, especially Muslims. If the laws given by the Holy Prophet are implemented in Pakistan today, then this country can be saved from the current economic, social and moral problems.
