شرعی عدالت قوانین کو غیر اسلامی قرار دینے کا اختیار رکھتی ہے: عدالتی معاون

The rulers will not listen until millions of people sit on the streets for a long time. Instead of hindering the commands of Allah, we have to follow it.
The court adjourned further hearing till tomorrow. Anwar Mansoor will complete his arguments by Friday.

چیف جسٹس نور محمد مسکانزئی کی سربراہی میں وفاقی شرعی عدالت کے تین رکنی بینچ نے سود ختم کرنے کی درخواستوں کی سماعت کی۔
عدالتی معاون انور منصور نے کہا کہ آئین کے مطابق ریاست دس سال میں ہر قسم کے استحصال کو ختم کرنے کی پابند ہے۔ سود بھی استحصال کی ایک شکل ہے۔ اسے غیر اسلامی قرار دینے کا اختیار رکھتا ہے۔
عدالتی معاون نے کہا کہ سود کا خاتمہ ضروری ہو گیا ہے، سپریم کورٹ نے بھی حکم دیا ہے کہ تمام قوانین اسلامی تعلیمات کے مطابق لائے جائیں، ایسی کوئی قانون سازی نہیں ہو سکتی جو قرآن و سنت سے متصادم ہو۔
عدالتی معاون انور منصور خان نے دلائل دیتے ہوئے کہا کہ پیسے سے خریدا نہیں جا سکتا اور نہ ہی بیچا جا سکتا ہے۔
سراج الحق نے روسٹرم پر آکر کہا کہ عدالت سے کچھ کہنا چاہتا ہوں۔ جب کے پی میں وزیر خزانہ تھے تو انہوں نے صوبے میں اسلامی بینکنگ کا آغاز کیا۔ انہوں نے تین سالوں میں کے پی کو سود اور قرضوں سے پاک صوبہ بنا دیا۔ طرف دیکھا تو قائداعظم کا نعرہ پاکستان کا مطلب لا الہ الا اللہ، قوم نے جواب دیا۔
سراج الحق نے کہا کہ گزشتہ بجٹ میں 33 ہزار ارب ممالک نے سود کی مد میں ادا کیا۔ وزیر خزانہ نے کہا کہ سود کی ادائیگی کے لیے مزید قرضہ لینا پڑے گا۔ جس کی وجہ سے ہم ابھی تک مقروض ہیں۔ قرضہ ہمیں بھنگ کے نشے کی طرح لگتا تھا کہ آج 47000 ارب تک پہنچ چکا ہے۔ شرعی عدالت نے ماضی میں سود کے خلاف فیصلہ دیا تھا۔
سراج الحق نے کہا کہ جاپان سود سے پاک معیشت کی طرف بڑھ رہا ہے۔ ہمیں آج دوست ملک سے ملنے والی خیرات پر سود ادا کرنا پڑے گا۔ حکمران اس وقت تک نہیں سنیں گے جب تک لاکھوں لوگ سڑکوں پر دھرنے نہیں دیتے۔ اللہ کے احکامات کی راہ میں رکاوٹ بننے کی بجائے اس پر عمل کرنا ہوگا۔
