National Assembly Passes A Bill Against Corporal Punishment Of Children

The National Assembly on Tuesday unanimously passed a bill against corporal punishment of children in Islamabad.

Entitled the ICT Prohibited Corporal Punishment Bill (IPCPB), the bill prohibits corporal punishment in the capital and imposes fines on those who physically punish children.

According to the details, the bill prohibits all forms of corporal punishment in public and private educational institutions, childcare institutions, and in the workplace.

It will also penalize people for physically abusing and harming people regardless of their intentions, which effectively repeals the provisions of Section 89 of the Pakistan Penal Code (PPC).

Section 89 of the PPC deals with the use of corporal punishment against children “done in good faith for the benefit of the child” and does not criminalize the use of corporal punishment against children.

The proposed bill will now be submitted to the Senate for approval, after which it will be signed.

These are the salient features of IPCPB.

Everyone under the age of 18 has been identified as a minor and will be included in the definition of children.
Corporal punishment against children will be prohibited in all educational institutions, child care institutions and in the workplace.
Slapping children, flogging them, beating them with sticks, shoes, wood or spoons, shaking them, cutting them, grabbing them by the hair or pulling their ears will be considered corporal punishment.
Corporal punishment includes child abuse, humiliation, defamation, and intimidation that can be punished with sabotage, suspension, dismissal, or forced retirement.
Children have the right to respect their individuality and individuality, and those who are subject to corporal punishment will not be eligible for any future employment.

’آئی سی ٹی ممنوعہ جسمانی سزا بل‘ (آئی پی سی پی بی) کے عنوان سے ، اس بل میں دارالحکومت میں جسمانی سزا سے منع کیا گیا ہے اور بچوں کو جسمانی طور پر سزا دینے والے افراد کے لئے جرمانے مقرر کیے گئے ہیں۔

تفصیلات کے مطابق ، اس بل میں ہر طرح کے سرکاری اور نجی تعلیمی اداروں ، بچوں کی دیکھ بھال کرنے والے اداروں ، اور کام کے مقامات پر ہر طرح کی جسمانی سزا پر پابندی عائد ہے۔

اس سے لوگوں کو ان کے ارادوں سے قطع نظر جسمانی زیادتی اور تکلیف پہنچانے پر بھی جرمانہ عائد کیا جائے گا ، جو پاکستان پینل کوڈ (پی پی سی) کے سیکشن 89 کی دفعات کو مؤثر طریقے سے کالعدم قرار دیتے ہیں۔

پی پی سی کا سیکشن 89 بچوں کے خلاف جسمانی نقصان کے استعمال کو “بچے کے فائدے کے لئے نیک نیتی کے ساتھ انجام دیا گیا” سمجھا جاتا ہے اور بچوں کے خلاف جسمانی سزا کے استعمال کو جرم نہیں سمجھتا ہے۔

مجوزہ بل اب منظوری کے لئے سینیٹ میں پیش کیا جائے گا جس کے بعد اس پر دستخط ہوجائیں گے۔

آئی پی سی پی بی کی نمایاں خصوصیات یہ ہیں۔

اٹھارہ سال سے کم عمر ہر فرد کی شناخت نابالغ کے طور پر کی گئی ہے اور وہ بچوں کی تعریف میں شامل ہوں گے۔
تمام تعلیمی اداروں ، بچوں کی دیکھ بھال کرنے والے اداروں اور کام کے مقامات پر بچوں کے خلاف جسمانی سزا ممنوع ہوگی۔
بچوں کو تھپڑ مارنا ، ان کو کوڑے مارنا ، لاٹھیوں ، جوتوں ، لکڑی یا چمچوں سے پیٹنا ، انھیں ہلانا ، کاٹنا ، بالوں سے پکڑنا یا کان کھینچنا جسمانی سزا سمجھا جائے گا۔
جسمانی سزا میں بچوں کے ساتھ بدسلوکی ، ذلت ، بدنامی اور دھمکی بھی شامل ہے جو تخریب کاری ، معطلی ، برخاستگی ، یا جبری ریٹائرمنٹ کے ساتھ قابل سزا ہوگی۔
بچوں کو اپنی شخصیت اور انفرادیت کا احترام کرنے کا حق ہے اور جسمانی سزا کے مجرم مستقبل میں کسی بھی ملازمت کے اہل نہیں ہوں گے۔
