The Sindh High Court (SHC) has ordered formation of a commission to probe the valuable assets and belongings of Quaid-e-Azam Muhammad Ali Jinnah and his sister Fatima Jinnah.
According to the report, a single judge bench of the Sindh High Court headed by Justice Zulfiqar Ahmed Khan pointed out that in a nearly 50-year-old case, detailed properties including cars, shares, jewelery and bank balances could never be traced. Many other upcoming items are also missing now.
The bench said that a one-member commission headed by Justice (retd) Faheem Ahmed Siddiqui would investigate the disappearance of various valuables and assets of Quaid-e-Azam and Fatima Jinnah.
He said the commission would have the power to seek help from anyone, government officials and call records from any institution.
During the hearing of the case, an Assistant Advocate General (AAG) told the court that on October 13, the bench took possession of Qasr Fatima, commonly known as Mohta Palace, and set up a medical college there. The order was suspended on November 8 by a two-judge division bench on an intra-court appeal by the provincial government.
The AAG requested adjournment of the hearing on the ground that the Advocate General of Sindh himself would give arguments on the matter.
However, counsel for the petitioner pointed out that only the government was prevented from taking possession of Mohta Palace and the rest of the order still exists.
A lawyer for the Mohta Palace Gallery Trust, which is currently looking after the inherited property, filed an application to intervene in the case and the bench issued notice to the plaintiff as well as the defendants on December 8.
In its order dated October 13, the bench had decided that it would take up the matter of recovery of all the assets left by the father of the nation and his sister and use all the powers at its disposal to bring these assets to light. Will do
The court also ordered the government to seize the inherited property and make a list of all the items in the building as well as set up a medical college with the consent of all parties.
However, a division bench of the Sindh High Court had restrained the government from taking possession of Qasr Fatima till November 18 as the provincial government had filed an intra-court appeal against the single bench’s October 13 order.
The case was initially filed by Hussain Waliji, a relative of Fatima Jinnah, in 1971 regarding the management of her movable and immovable property, including Qasr Fatima, and after the death of the original plaintiff, her son Amir Ali was nominated as the petitioner. was done.
However, he also died during the trial and his son Nazish Amir Ali became part of the operation.
Legal proceedings were initiated after the death of Fatima Jinnah on July 10, 1967, after her only surviving sister, Shereen Jinnah, was given a certificate of such property.

13 اکتوبر کو اپنے حکم نامے میں، بنچ نے فیصلہ کیا تھا کہ وہ بابائے قوم اور ان کی بہن کے چھوڑے گئے تمام اثاثوں کی بازیابی کا معاملہ اٹھائے گا اور ان اثاثوں کو منظر عام پر لانے کے لیے اپنے اختیار میں تمام اختیارات استعمال کرے گا۔ کروں گا

مقدمہ ابتدائی طور پر فاطمہ جناح کے رشتہ دار حسین ولی جی نے 1971 میں قصر فاطمہ سمیت ان کی منقولہ اور غیر منقولہ جائیداد کے انتظام کے حوالے سے دائر کیا تھا اور اصل مدعی کی وفات کے بعد ان کے بیٹے امیر علی کو درخواست گزار نامزد کیا گیا تھا۔ ہو گیا تھا.

جولائی10 1967 کو فاطمہ جناح کی موت کے بعد ان کی واحد زندہ بچ جانے والی بہن شیریں جناح کو ایسی جائیداد کا سرٹیفکیٹ دینے کے بعد قانونی کارروائی شروع کی گئی۔
