پرویز مشرف اور آصف علی زرداری سے متعلق زیر التوا مقدمات کی سماعت کے لیے ایک نیا بنچ تشکیل دیا گیا ہے
A new three-member bench has been constituted to hear pending cases related to former Prime Minister Yousuf Raza Gilani, former presidents Pervez Musharraf and Asif Ali Zardari.
The full bench will be headed by Chief Justice Lahore High Court Justice Amir Bhatti and other members include Justice Shujaat Ali Khan and Justice Ayesha A. Malik.
It should be noted that the Lahore High Court has constituted a full bench to hear 10-year-old cases.
Last month, a High Court bench hearing former presidents’ cases broke up.
A three-member bench of the Lahore High Court headed by Chief Justice Amir Bhatti and comprising Justice Shujaat Ali Khan and Justice Shehzad Khan was hearing the cases against Asif Ali Zardari, Pervez Musharraf and Yousuf Raza Gilani.
However, Justice Shehzad Malik, a member of the three-member full bench, apologized for being part of the bench, on which the three-member full bench of the Lahore High Court was dissolved at the first hearing.
During the hearing of the case, the Chief Justice of Lahore High Court said that Justice Malik Shehzad Ahmed Khan did not want to be a part of the three-member bench.
He said that although the petitions had become ineffective, the benches could not issue orders due to their dissolution. Petitioner’s Advocate Rana Alam-ud-Din Ghazi had filed a petition against the imposition of emergency by former President Pervez Musharraf.
In addition, Advocate Rana Alumuddin Ghazi and others had filed a petition seeking two posts for former President Asif Ali Zardari.
Shahid Naseem Gondal and Allah Bakhsh Gondal advocates had filed petitions seeking disqualification of former Prime Minister Yousuf Raza Gilani.

فل بنچ کی سربراہی چیف جسٹس لاہور ہائیکورٹ جسٹس امیر بھٹی کریں گے اور دیگر ارکان میں جسٹس شجاعت علی خان اور جسٹس عائشہ اے ملک شامل ہیں۔
واضح رہے کہ لاہور ہائی کورٹ نے 10 سال پرانے مقدمات کی سماعت کے لیے فل بنچ تشکیل دیا ہے۔
پچھلے مہینے ہائی کورٹ کا ایک بینچ سابق صدور کے مقدمات کی سماعت کر رہا تھا۔
لاہور ہائی کورٹ کا تین رکنی بینچ چیف جسٹس امیر بھٹی کی سربراہی میں اور جسٹس شجاعت علی خان اور جسٹس شہزاد خان پر مشتمل تھا جو آصف علی زرداری ، پرویز مشرف اور یوسف رضا گیلانی کے خلاف مقدمات کی سماعت کر رہا تھا۔
تاہم تین رکنی فل بنچ کے رکن جسٹس شہزاد ملک نے بینچ کا حصہ بننے سے معذرت کر لی جس پر لاہور ہائیکورٹ کا تین رکنی فل بنچ پہلی سماعت پر تحلیل ہو گیا۔
کیس کی سماعت کے دوران چیف جسٹس لاہور ہائیکورٹ نے کہا کہ جسٹس ملک شہزاد احمد خان تین رکنی بنچ کا حصہ نہیں بننا چاہتے۔
انہوں نے کہا کہ اگرچہ درخواستیں غیر موثر ہو چکی ہیں ، بنچ ان کے تحلیل ہونے کی وجہ سے احکامات جاری نہیں کر سکے۔ درخواست گزار کے وکیل رانا عالم الدین غازی نے سابق صدر پرویز مشرف کی جانب سے ایمرجنسی نافذ کرنے کے خلاف درخواست دائر کی تھی۔
اس کے علاوہ ایڈووکیٹ رانا عالم الدین غازی اور دیگر نے سابق صدر آصف علی زرداری کے لیے دو عہدوں کے لیے درخواست دائر کی تھی۔
شاہد نسیم گوندل اور اللہ بخش گوندل کے وکلاء نے سابق وزیراعظم یوسف رضا گیلانی کی نااہلی کے لیے درخواستیں دائر کی تھیں۔
