حراست میں ملزمان پر تشدد کرنے پر پاکستان نے لوگوں کو جیل بھیج دیا
سینیٹ کی فنکشنل کمیٹی برائے ہیومن رائٹس نے منگل کو ایک بل کی منظوری دی جس کے تحت زیر حراست مشتبہ افراد پر تشدد اور موت کی سزا دی گئی ہے۔
تشدد اور حراستی موت (روک تھام اور سزا) ایکٹ 2020 کے مطابق ، کسی کو بھی حراست میں رکھنے پر کسی پر تشدد کرنے کا الزام ثابت ہونے پر اسے تین سال سے زیادہ کے لئے جیل بھیجا جائے گا اور بیس لاکھ روپے جرمانہ بھی کیا جائے گا۔
دوسری طرف ، حراست میں ہراساں کرنا یا موت سے 30 لاکھ روپے جرمانہ ہوگا۔ یہ ناقابل ضمانت جرم ہوگا۔
قانون میں کہا گیا ہے کہ اس جرم کے واقعہ کو یقینی بنانے کے ذمہ دار فرد کو پانچ سال قید اور 10 لاکھ روپے جرمانے کی سزا دی جائے گی اگر وہ اس سے بچنے میں ناکام رہے ہیں۔
کسی مرد کو کسی خاتون کو مشتبہ خاتون کو حراست میں رکھنے کی اجازت نہیں ہوگی۔
عدالت حراست میں تشدد کا نشانہ بننے والے شکایت کنندہ کا بیان ریکارڈ کرے گی اور پھر اس شخص کا نفسیاتی اور جسمانی معائنہ کرے گی۔ بل کے مطابق ، اگر یہ تشدد ثابت ہوتا ہے تو پھر کیس سیشن کورٹ میں بھیجا جائے گا۔
عدالت اس معاملے پر جرم کے 60 دن کے اندر فیصلہ سنانے کے پابند ہوگی۔ اس سے متعلق اپیل 30 دن میں ہائی کورٹ میں کی جاسکتی ہے۔
قانون میں مزید کہا گیا کہ عدالت میں تمام سماعتوں کے دوران شکایت کنندہ کو سیکیورٹی بھی فراہم کی جائے گی۔
یہ بل پیپلز پارٹی کی سینیٹر شیری رحمان نے سینیٹ میں پیش کیا۔ انہوں نے کہا کہ ملک کو “سرکاری حراست میں ہونے والے اکثر پُرتشدد زیادتیوں کو روکنے کی بری طرح ضرورت ہے جو ہمارا کمزور اور غیر طاقت ور چہرہ ہے۔”
سوشل میڈیا پر خاص طور پر انسانی حقوق کے محافظوں کی طرف سے اس قانون کی تعریف کی گئی ہے۔
The Senate Functional Committee on Human Rights on Tuesday approved a bill that would have sentenced detainees to torture and death.
According to the Violence and Detention Death (Prevention and Punishment) Act 2020, anyone found guilty of torturing a detainee will be jailed for more than three years and fined Rs 2 million. Will
On the other hand, harassment or death in custody would result in a fine of Rs 3 million. It would be a non-bailable offense.
The law states that the person responsible for ensuring the occurrence of this crime will be sentenced to five years imprisonment and a fine of Rs. 1 million if he fails to avoid it.
No man will be allowed to detain a woman suspect.
The court will record the statement of the complainant who was tortured in custody and then conduct a psychological and physical examination of the person. According to the bill, if the violence is proven, then the case will be sent to the Sessions Court.
The court will be bound to rule on the matter within 60 days of the crime. An appeal can be made to the High Court within 30 days.
The law added that the complainant would also be provided security during all court hearings.
The bill was introduced in the Senate by PPP Senator Sherry Rehman. He said the country “desperately needs to stop the most violent abuses in government custody, which is our weak and powerless face.”
The law has been praised on social media, especially by human rights defenders.
