SC orders reopening of shopping malls across the country

The malls which were closed during the lockdown to curb the coronavirus pandemic have now ordered Pakistan’s Supreme Court to reopen across the country on Monday during the Suo Moto case hearing regarding anti-virus outbreak measures. The five-member bank was headed by Supreme Judge of Pakistan (CJP) Gulzar Ahmed, while judges Umar Ata Bandial, judges Mazhar Alam Khan Miankhel, judges Sajjad Ali Shah and judges Qazi Muhammad Amin Ahmed also sat on the bench. Pakistan’s chief judge, Gulzar Ahmed, noted during the hearing that store owners “die of starvation rather than coronavirus” when shops close.

CJP Ahmed said that in Karachi, with the exception of five major shopping malls, every market has resumed operations. Commissioner Karachi Iftikhar Shallwani then said that some markets had been sealed because they had failed to follow the government’s standard operating procedures. “The sealed markets should be opened and instead of intimidating them (shopkeepers), they should be understood (the situation and the SOPs),” said the senior judge. The Pakistani Attorney General also presented arguments by video link from the Karachi register during today’s hearing, while the additional Attorney General appeared in court.

The CJP was outraged at the violation of decisions made during National Command and Operations Center meetings. The CJP then asked why the markets were closed at the weekend and said the court would order in writing that the small markets would remain open on Saturday and Sunday. The CJP found that SOPs are “better implemented” in large shopping centers. The Supreme Court also ordered all small markets to remain open to the public on weekends.

کورونا وائرس وبا کو روکنے کے لئے لاک ڈاؤن کے دوران جو مالز بند ہوگئے تھے اب انھوں نے کرونا وائرس پھیلنے کے اقدامات سے متعلق سو موٹو کیس کی سماعت کے دوران پیر کو سپریم کورٹ آف پاکستان نے ملک بھر میں مالز کو دوبارہ کھولنے کا حکم دیا ہے۔ پانچ رکنی بنک کی سربراہی سپریم کورٹ آف پاکستان (سی جے پی) گلزار احمد نے کی ، جبکہ جج عمر عطا بندیال ، جج مظہر عالم خان میاں خیل ، جج سجاد علی شاہ اور جج قاضی محمد امین احمد بھی بنچ میں شامل تھے۔ چیف جسٹس آف پاکستان گلزار احمد نے سماعت کے دوران کہا کہ دکانیں بند ہونے پر اسٹور مالکان “کورونا وائرس کی بجائے بھوک سے مر رہے ہیں”۔

چیف جسٹس آف پاکستان احمد نے بتایا کہ کراچی میں پانچ بڑے شاپنگ مالز کو چھوڑ کر ہر مارکیٹ نے دوبارہ کام شروع کردیا ہے۔ تب کمشنر کراچی افتخار شلوانی نے کہا کہ کچھ مارکیٹوں کو سیل کردیا گیا ہے کیونکہ وہ حکومت کے معیاری آپریٹنگ طریقہ کار پر عمل کرنے میں ناکام رہے ہیں۔ سینئر جج نے کہا ، “سیل بازاروں کو کھولنا چاہئے اور انہیں (دکانداروں) کو دھمکانے کے بجائے ، انہیں (صورتحال اور ایس او پیز) کو سمجھنا چاہئے۔ پاکستانی اٹارنی جنرل نے آج کی سماعت کے دوران کراچی رجسٹر سے ویڈیو لنک کے ذریعے دلائل بھی پیش کیے جبکہ ایڈیشنل اٹارنی جنرل عدالت میں پیش ہوئے۔

چیف جسٹس نیشنل کمانڈ اور آپریشن سنٹر میٹنگز کے دوران کیے گئے فیصلوں کی خلاف ورزی پر مشتعل ہوگئے۔ چیف جسٹس نے پھر سوال کیا کہ ہفتے کے آخر میں بازاروں کو کیوں بند کردیا گیا اور کہا عدالت تحریری طور پر حکم دے گی کہ چھوٹی منڈیاں ہفتے اور اتوار کو کھلی رہیں گی۔ چیف جسٹس نے نوٹ کیا کہ بڑے شاپنگ سینٹرز میں ایس او پیز کو “بہتر انداز میں لاگو کیا جاتا ہے”۔ سپریم کورٹ نے ہفتے کے آخر میں تمام چھوٹی منڈیوں کو عوام کے لئے کھلا رہنے کا بھی حکم دیا۔
