سپریم کورٹ نے سندھ حکومت کا 25 ہزار روپے کم از کم اجرت کا نوٹیفکیشن معطل کر دیا
The Supreme Court of Pakistan (SC) on Wednesday suspended the Sindh government’s July 19 notification setting a minimum monthly wage of Rs 25,000 and decided to form a three-member bench to hear the matter next month. ۔
A two-member bench of the apex court comprising Justice Qazi Faiz Issa and Justice Yahya Afridi issued notices to Attorney General Khalid Javed Khan and Sindh Advocate General Salman Talib-ud-Din on the appeals filed by various petitioners.
Applicants include Federation of Pakistan Chambers of Commerce and Industry, The Employees Federation of Pakistan, Phoenix Security Services (Pvt) Ltd. Karachi, Aziz Tabia Foundation Karachi, Gray Merchant Restaurant International Limited Karachi and SRG Service (Pvt) Karachi.
The agencies had challenged the notification of minimum wage by taking the position that their agency is an inter-provincial body which falls under the jurisdiction of the federal government to fix the minimum wage. Low Wages Act 2015 does not apply.
At least six petitioners questioned the Sindh High Court’s order in favor of the provincial government’s notification dated October 15, while others approached the apex court to become a party to the dispute with the petition. He was impressed by the court order.
سپریم کورٹ آف پاکستان (ایس سی) نے بدھ کے روز سندھ حکومت کا 19 جولائی کو کم از کم ماہانہ اجرت 25,000 روپے مقرر کرنے کا نوٹیفکیشن معطل کردیا اور اگلے ماہ اس معاملے کی سماعت کے لیے تین رکنی بینچ تشکیل دینے کا فیصلہ کیا۔ ۔
جسٹس قاضی فائز عیسیٰ اور جسٹس یحییٰ آفریدی پر مشتمل عدالت عظمیٰ کے دو رکنی بینچ نے مختلف درخواست گزاروں کی جانب سے دائر اپیلوں پر اٹارنی جنرل خالد جاوید خان اور ایڈووکیٹ جنرل سندھ سلمان طالب الدین کو نوٹس جاری کردیئے۔
درخواست دہندگان میں فیڈریشن آف پاکستان چیمبرز آف کامرس اینڈ انڈسٹری، دی ایمپلائز فیڈریشن آف پاکستان، فینکس سیکیورٹی سروسز (پرائیویٹ) لمیٹڈ کراچی، عزیز تبیہ فاؤنڈیشن کراچی، گرے مرچنٹ ریسٹورنٹ انٹرنیشنل لمیٹڈ کراچی اور ایس آر جی سروس (پرائیویٹ) کراچی شامل ہیں۔
ایجنسیوں نے کم از کم اجرت کے نوٹیفکیشن کو یہ موقف اختیار کرتے ہوئے چیلنج کیا تھا کہ ان کی ایجنسی ایک بین الصوبائی ادارہ ہے جو کم از کم اجرت طے کرنا وفاقی حکومت کے دائرہ اختیار میں آتا ہے۔ کم اجرت ایکٹ 2015 لاگو نہیں ہوتا ہے۔
کم از کم چھ درخواست گزاروں نے 15 اکتوبر کو صوبائی حکومت کے نوٹیفکیشن کے حق میں سندھ ہائی کورٹ کے حکم پر سوال اٹھایا، جب کہ دیگر نے پٹیشن کے تنازع میں فریق بننے کے لیے سپریم کورٹ سے رجوع کیا۔ وہ عدالتی حکم سے متاثر ہوئے۔
