اے پی ایس حملہ کیس: حکومت کے پاس جواب دینے کے لئے چار ہفتے ہیں

چیف جسٹس گلزار احمد نے وفاقی حکومت کو اے پی ایس پشاور اٹیک کیس سے متعلق تحقیقاتی رپورٹ پر اپنا جواب پیش کرنے کے لئے چار ہفتوں کی مہلت دی۔

پشاور میں آرمی کے زیر انتظام ایک اسکول میں 16 دسمبر 2014 کو 140 سے زائد بچوں اور اسکول کے کارکنوں کو گولی مار کر ہلاک کردیا گیا تھا۔ اس حملے کا الزام کالعدم تحریک طالبان پاکستان نے عائد کیا تھا۔

ایک تحقیقاتی کمیٹی نے عدالت میں اپنی رپورٹ پیش کرنے کے بعد جج گلزار احمد اور جج اعجاز الاحسن پر مشتمل سپریم کورٹ کے دو رکنی بینچ نے ازخود کیس کا نوٹس لیا۔

سماعت اس وقت شروع ہوئی جب شہید بچوں کے والدین نے عدالت سے تحقیقات کو تیز کرنے کا کہا۔ جسٹس احمد نے تاخیر پر افسوس کا اظہار کیا اور والدین کو یقین دلایا کہ انصاف کیا جائے گا۔

والدین نے یہ بھی درخواست کی کہ حملے سے متعلق تحقیقاتی رپورٹ شائع کی جائے۔ انہوں نے کہا کہ حملے میں ملوث دہشت گردوں کو سزا دی گئی تھی ، لیکن ان کے بیچارے افراد کو بھی سزا دی جانی چاہئے۔

اس سلسلے میں ، جسٹس احسن نے والدین کو تسلی دی اور ان سے وعدہ کیا کہ انہیں انصاف دیا جائے گا۔

اس معاملے میں حکومت سے قانونی مشورے کے بعد اٹارنی جنرل کو ذاتی طور پر اگلی سماعت پر طلب کیا گیا تھا۔ بینچ نے اعلان کیا کہ جب تک اٹارنی جنرل کی طرف سے جواب موصول نہیں ہوتا معاملہ آگے نہیں بڑھے گا۔ اس لئے اگلی سماعت چار ہفتوں کے لئے ملتوی کردی گئی۔

جولائی میں ، حملے کی تحقیقات کے لئے قائم عدالتی کمیشن نے 3،000 صفحات پر مشتمل تحقیقاتی رپورٹ عدالت میں پیش کی۔ اس میں 101 گواہوں اور 31 پولیس افسران اور قانون نافذ کرنے والے دیگر افسران کی گواہی شامل ہے۔ اس رپورٹ کو پشاور ہائی کورٹ کے جج محمد ابراہیم خان نے تیار کیا تھا۔

اکتوبر 2018 میں ، سابق سپریم کورٹ کے جسٹس ثاقب نثار نے جج خان کی سربراہی میں ایک رکنی کمیشن تشکیل دیا۔ کمیشن کے قیام کے بعد بچوں کے والدین نے حکام سے قتل عام کی تحقیقات کے لئے ایک اعلی سطح کا کمیشن تشکیل دینے کا مطالبہ کیا تھا۔

پاکستان نے دسمبر 2015 میں فوج کے زیر انتظام اسکول پر حملے میں حصہ لینے پر چار افراد کو پھانسی دے دی۔ انہیں فوجی عدالت نے سزا سنائی اور ان کی سزائے موت کی تصدیق اس وقت کے آرمی چیف نے کی۔

Chief Justice Gulzar Ahmed gave the federal government four weeks to respond to the investigation report into the APS Peshawar attack case.

More than 140 children and school workers were shot dead December 16, 2014, at an Army-run school in Peshawar. The attack was blamed on the banned Tehreek-e-Taliban Pakistan.

A two-member bench of the Supreme Court comprising Judge Gulzar Ahmed and Justice Ijaz-ul-Ahsan took notice of the case after an inquiry committee presented its report in the court.

The hearing began when the parents of the martyred children asked the court to expedite the investigation. Justice Ahmed expressed regret over the delay and assured the parents that justice would be done.

The parents also requested that an investigation report into the attack be published. He said that the terrorists involved in the attack were punished, but their poor people should also be punished.

In this regard, Justice Ahsan reassured the parents and promised them justice.

Following legal advice from the government, the attorney general was personally summoned to the next hearing. The bench announced that the matter would not proceed till a reply was received from the Attorney General. Therefore, the next hearing was adjourned for four weeks.

In July, a judicial commission set up to investigate the attack submitted a 3,000-page investigation report to the court. It includes the testimony of 101 witnesses and 31 police officers and other law enforcement officers. The report was prepared by Peshawar High Court Judge Muhammad Ibrahim Khan.

In October 2018, former Supreme Court Justice Saqib Nisar formed a one-member commission headed by Judge Khan. After the commission was set up, the children’s parents called on the authorities to set up a high-level commission to investigate the massacre.

Pakistan executed four people for taking part in an attack on an army-run school in December 2015. He was sentenced by a military court and his death sentence was upheld by the then army chief.
