SC takes up contempt case again today

(eNews.pk) - ISLAMABAD: The Supreme Court will resume hearing on several identical petitions challenging contempt of Court Act again today (Wednesday).




On Tuesday, Chief Justice Iftikhar Muhammad Chaudhry, observed that the contempt of the new Court Act of 2012 seemed to be against the administration of justice, while the old law was to ensure the enforcement of court orders.
During the procedure, the CJ said that the contempt of court law was an important tool in the hands of the judiciary to ensure that his orders were carried out. Expressing regret, the Chief Justice called the practice of changing the laws in a hurry, as an effort incorrect.
The CJ said Section 4 has been added to the Act for the punishment could no longer be effective, adding that it seemed as if this was a mistake by the draftsman.

اسلام آباد… توہين عدالت کے نئے قانون کيخلاف درخواستوں کي سماعت آج بھي ہوگي.چيف جسٹس پاکستان نے کہاکہ ہے عدالتي فيصلوں پر عمل کرانے کيلئے توہين عدالت کا قانون موثرترين ہتھيار ہے.گزشتہ روز کيس کي سماعت ميں وکلا کے دلائل سننے کے بعدچيف جسٹس نے کہاکہ نئے قانون ميں سيکشن-4 اس ليے ہے کہ عدالتي فيصلہ غير موثر ہونے سے سزا ہي نہ ہوسکے. کسي کو الزام نہيں ديتے ليکن راتوں رات قانون بدلنا درست نہيں، ايسا لگتا ہے نئے قانون کا مسودہ بنانے والے سے غلطي ہو گئي ، نيا قانون انصاف کي فراہمي ميں رکاوٹ نظر آتا ہے.انھوں نے کہا کہ عدالتي فيصلوں پر عمل کرانے کيليے توہين عدالت کا قانون موثرترين ہتھيار ہے.يہ عدالتي اختيار کسي جج کي ذاتي اناکيلئے نہيں بلکہ انصاف کي فراہمي کيلئے ہوتا ہے.
