ISLAMABAD: The Supreme Court of Pakistan (SC) has resumed the hearing of petitions challenging the same NA Speaker Dr Fehmida Mirza judgments not to send a reference point for the disqualification of the Prime Minister to the Election Commission of Pakistan (ECP) and the attorney general has completed his arguments, Geo news reported Tuesday.
Three judges of the apex court headed by Chief Justice Iftikhar Muhammad Chaudhry and comprising Justice Jawad S Khawaja and Justice Khilji Arif Hussain heard the identical petitions submitted by the PML-N, Tehreek-e-Insaf and others against the judgment NA speaker on the disqualification of the Prime Minister.
During its arguments, the prosecutor general Irfan Qadir claimed that the Prime Minister does not respond to the courts as he enjoys immunity under Article 248. He further said that there were no clashes between the institutions and that only Parliament can disqualify any member of the National Assembly (MNA).
While backing, the AG said that parliament has approved a resolution in favor of the judgment of the speaker, as was feared that the judges may issue such orders illegal in the future. He said that the parliament has the right to delete any court order against the speaker.
The parliament on Thursday approved a resolution in favor of the speaker's judgment, the refusal to disqualify Prime Minister Yousaf Raza Gilani after his conviction in contempt of court case, stating that it could not be questioned.
The Chief Justice noted that the judges about the Parliament and there would be no clash between the institutions. The courts are only its tasks.
The Attorney General has observed about the judicial contempt which the Chief Justice instructed him to avoid irrelevant arguments.

اسلام آباد… سپريم کورٹ ميں اسپيکر رولنگ کيس کي سماعت جاري ہے جس کے دوران اٹارني جنرل عرفان قادر نے اپنے دلائل مکمل کر لئے ہيں. کيس کي سماعت چيف جسٹس کي سربراہي ميں تين رکني بينچ کر رہا ہے جس کے دوران اٹارني جنرل عرفان قادر نے دلائل ديتے ہوئے کہا ہے کہ وزيراعظم عدالتوں کو جوابدہ نہيں ، آئين کے آرٹيکل 248 وزيراعظم کو استثنا حاصل ہے . انہوں نے دلائل ديتے ہوئے کہا کہ اداروں کے مابين کوئي تصادم نہيں اور نہ ہي ہونا چاہيئے جبکہ کسي رکن قومي اسمبلي کو نااہل قرار دينا پارليمنٹ کا کام ہے. اسپيکرکي رولنگ کے حوالے سے اٹارني جنرل نے دلائل ديتے ہوئے کہا کہ پارليمنٹ ميں اسپيکر کي رولنگ کے حوالے سے قراردا د اس لئے منظور کي کہ سات رکني بنچ نے جس طرح غير قانوني آرڈر پاس کيا ، خدشہ تھا کہ اس طرح کا کوئي اور آرڈر نہ آجائے. اٹارني جنرل نے دلائل ديتے ہوئے کہا کہ کہا کہ عدالت اسپيکر کے خلاف کوئي فيصلہ سنا دے، تو پارليمنٹ اس کو ختم کرسکتي ہے. چيف جسٹس نے ريمارکس ديتے ہوئے کہا کہ عدالت پارليمنٹ کا مکمل احترام کرتے ہيں ، انھوں نے کہا کہ عدليہ اپنا کام کر رہي ہے، اداروں ميں کوئي ٹکراو نہيں ہوگا. اٹارني جنرل نے دلائل جاري ر کھتے ہوئے کہا کہ عد ليہ کو توہين عدالت کا اختيار آئين کے آرٹيکل 19 اے سے مطابقت نہيں رکھتا، اور اپ رائٹ جج شايد ہي توہين عدالت کااختيار استعمال کرتا ہو، جس پر چيف جسٹس نے کہا کہ يہ توہين عدالت کا کيس نہيں ، غير متعلقہ باتيں نہ کي جائيں.
