رانا شمیم کی ای سی ایل میں نام ڈالنے کی درخواست مسترد
The High Court rejected the petition of former Chief Justice of Gilgit-Baltistan Rana Shamim to be included in the ECL.
A hearing was held in the Islamabad High Court on the request of former Chief Justice of Gilgit-Baltistan Rana Shamim to be included in the ECL. High Court Chief Justice Athar Minallah heard the petition.
Lawyer Petitioner Rai Nawaz Kharal argued in the court that Rana Shamim’s name should be added to ECL, what would happen if former Chief Justice fled the country sooner or later, his name should be added to ECL or He should surrender his passport somewhere. Chief Justice Athar Minallah inquired that this is the work of the government and not the work of this court, how can you be a party in a contempt of court case.
The petitioner’s counsel replied to the court that he had all the information about former Chief Justice Saqib Nisar. On which Chief Justice Atharmanullah remarked that let him know and let him know, contempt of court case is the court’s own matter. The court declared the petition seeking inclusion of former Gilgit-Baltistan Chief Justice Rana Shamim’s name in the ECL inadmissible.
The High Court ruled that petitions seeking inclusion of Rana Shamim in the ECL and his involvement in the case as a party were rejected. No one else can claim to be a party in the case. The request to be a party in a contempt of court case is the result of a misunderstanding. This request is not admissible.
ہائیکورٹ نے سابق چیف جسٹس گلگت بلتستان رانا شمیم کا نام ای سی ایل میں ڈالنے کی درخواست مسترد کر دی۔
اسلام آباد ہائی کورٹ میں سابق چیف جسٹس گلگت بلتستان رانا شمیم کا نام ای سی ایل میں ڈالنے کی درخواست پر سماعت ہوئی۔ ہائی کورٹ کے چیف جسٹس اطہر من اللہ نے درخواست پر سماعت کی۔
وکیل درخواست گزار رائے نواز کھرل نے عدالت میں دلائل دیتے ہوئے کہا کہ رانا شمیم کا نام ای سی ایل میں ڈالا جائے، سابق چیف جسٹس جلد یا بدیر ملک سے بھاگ گئے تو کیا ہوگا، ان کا نام ای سی ایل میں ڈالا جائے یا پاسپورٹ کہیں سرنڈر کریں۔ چیف جسٹس اطہر من اللہ نے استفسار کیا کہ یہ حکومت کا کام ہے اس عدالت کا کام نہیں، آپ توہین عدالت کیس میں فریق کیسے بن سکتے ہیں۔
درخواست گزار کے وکیل نے عدالت کو جواب دیا کہ سابق چیف جسٹس ثاقب نثار سے متعلق تمام معلومات ہیں۔ جس پر چیف جسٹس اطہرمن اللہ نے ریمارکس دیے کہ بتائیں اور بتائیں، توہین عدالت کیس عدالت کا اپنا معاملہ ہے۔ عدالت نے گلگت بلتستان کے سابق چیف جسٹس رانا شمیم کا نام ای سی ایل میں شامل کرنے کی درخواست ناقابل سماعت قرار دے دی۔
ہائیکورٹ نے فیصلہ سناتے ہوئے رانا شمیم کا نام ای سی ایل میں شامل کرنے اور کیس میں بطور فریق شامل کرنے کی درخواستیں مسترد کر دیں۔ مقدمہ میں فریق بننے کا دعویٰ کوئی اور نہیں کر سکتا۔ توہین عدالت کیس میں فریق بننے کی درخواست غلط فہمی کا نتیجہ ہے۔ یہ درخواست قابل قبول نہیں ہے۔
