Justice Athar Minallah said that the published news gave the impression that all the judges of this High Court were compromised. I asked them why they took oath in UK. If their conscience was awakened, would they submit it on a forum? What was its purpose? There is no one in the locker, your client has to prove that his action was not malicious, no judge can say that he was under pressure, if he takes pressure he is not an independent judge, if there is trust within the judge. Otherwise I can’t blame anyone else, this is my accountability, this is the accountability of my High Court.
Chief Justice Athar Minallah asked where is the original affidavit? Rana Shamim’s lawyer Latif Afridi replied that the affidavit was with his grandson in the UK, but my client could not contact his grandson.
The Chief Justice directed that wherever there is an original affidavit, you will see it. Hesitating to do.
Latif Afridi said that Rana Shamim did not deny the affidavit, however he did not give the affidavit for publication, Rana Shamim’s son is being harassed.
The court said who could harass him in the UK? Who harassed Young Man in the UK? Who is harassing them, now they have to tell who is harassing them outside Pakistan? He had to give the affidavit to the Pakistani embassy. Where is the original affidavit?
Lawyer Latif Afridi said that let him go, he will bring the original affidavit.
Chief Justice Athar Minallah said, “No, no, they can’t go. The only problem is that the person sitting on the chair does not have a conscience at that time. I challenge that none of my judges has ever opened the door for anyone.” It is not our concern regarding the Chief Justice of Pakistan but the judges of this High Court are to blame. Should an inquiry be started against everyone including me? What does that mean?
Lawyer Latif Afridi said that his client says that he agrees with the text of the affidavit that has been published.
The Islamabad High Court, while delivering a major verdict, said that if the affidavit was not submitted by Monday, the accused would be charged. The court adjourned the case till Monday.
It should be noted that the court has started contempt proceedings after the news was published in the newspaper. The court had on November 30 ordered Rana Shamim to file a reply to the show cause notice within four days and to submit the original affidavit from the UK. Rana Shamim submitted reply to the show cause notice but did not submit the original affidavit.

اسلام آباد ہائی کورٹ میں گلگت بلتستان کے سابق چیف جسٹس رانا شمیم کے بیان حلفی کی خبر پر توہین عدالت کیس کی سماعت ہوئی۔ رانا شمیم ہائیکورٹ میں پیش ہوئے۔
عدالتی معاون فیصل صدیقی نے کہا کہ یہ پرائیویٹ دستاویز تھی، اسے شائع کرنے کے لیے نہیں رکھا، رانا شمیم کا کہنا ہے کہ اس کے شائع ہونے کے بعد مجھ سے رابطہ کیا گیا، جب کہ رپورٹر کا کہنا تھا کہ اس نے خبر شائع کی۔ پہلے رابطہ کیا۔
چیف جسٹس اطہر من اللہ نے استفسار کیا کہ کیا ریما عمر آئی ہیں؟ وکیل نے جواب دیا کہ ریما عمر نہیں آئیں لیکن انہوں نے اپنا بریف عدالت میں جمع کرایا ہے۔
چیف جسٹس نے ریمارکس دیئے کہ بیان دیا گیا تھا کہ الیکشن سے پہلے کسی مخصوص شخص کی ضمانت نہیں ہوگی کیونکہ ججز دباؤ میں ہیں۔ سابق جج رانا شمیم نے تین سال بعد حلف اٹھایا جب کہ رخصت پر جسٹس محسن اختر کیانی اور جسٹس میاں گل حسن اورنگزیب موجود تھے۔ دو ہفتے بعد ایک اور بنچ جس میں میں موجود تھا نے بھی ریلیف دیا۔
جسٹس اطہر من اللہ نے کہا کہ شائع شدہ خبروں سے یہ تاثر ملتا ہے کہ اس ہائی کورٹ کے تمام ججز سمجھوتہ کر چکے ہیں۔ میں نے ان سے پوچھا کہ انہوں نے برطانیہ میں حلف کیوں اٹھایا؟ اگر ان کا ضمیر جاگتا تو کیا وہ کسی فورم پر جمع کراتے؟ اس کا مقصد کیا تھا؟ لاکر میں کوئی نہیں ہے، آپ کے مؤکل کو ثابت کرنا ہوگا کہ اس کا عمل بدنیتی پر مبنی نہیں تھا، کوئی جج یہ نہیں کہہ سکتا کہ وہ دباؤ میں تھا، اگر وہ دباؤ ڈالے گا تو وہ آزاد جج نہیں، اگر جج کے اندر اعتماد ہے۔ ورنہ میں کسی اور پر الزام نہیں لگا سکتا، یہ میرا احتساب ہے، یہ میری ہائی کورٹ کا احتساب ہے۔
چیف جسٹس اطہر من اللہ نے پوچھا کہ اصل حلف نامہ کہاں ہے؟ رانا شمیم کے وکیل لطیف آفریدی نے جواب دیا کہ بیان حلفی برطانیہ میں ان کے پوتے کے پاس تھا، لیکن میرے موکل کا پوتے سے رابطہ نہیں ہو سکا۔
چیف جسٹس نے ہدایت کی کہ جہاں بھی اصل حلف نامہ ہے وہ دیکھ لیں گے۔ کرنے سے ہچکچاتے ہیں۔
لطیف آفریدی نے کہا کہ رانا شمیم نے بیان حلفی کی تردید نہیں کی البتہ بیان حلفی شائع کرنے کے لیے نہیں دیا، رانا شمیم کے بیٹے کو ہراساں کیا جا رہا ہے۔
عدالت نے کہا کہ برطانیہ میں کون ہراساں کر سکتا ہے؟ برطانیہ میں ینگ مین کو کس نے ہراساں کیا؟ انہیں کون ہراساں کر رہا ہے، اب انہیں بتانا ہو گا کہ پاکستان سے باہر انہیں کون ہراساں کر رہا ہے۔ انہوں نے بیان حلفی پاکستانی سفارت خانے کو دینا تھا۔ اصل حلف نامہ کہاں ہے؟
وکیل لطیف آفریدی نے کہا کہ جانے دیں، اصل حلف نامہ لے کر آئیں گے۔
چیف جسٹس اطہر من اللہ نے کہا کہ نہیں، نہیں، وہ نہیں جاسکتے، مسئلہ صرف یہ ہے کہ کرسی پر بیٹھے شخص کا اس وقت ضمیر نہیں ہوتا، میں چیلنج کرتا ہوں کہ میرے کسی جج نے آج تک دروازہ نہیں کھولا۔ کوئی بھی۔” چیف جسٹس آف پاکستان کے حوالے سے ہماری فکر نہیں بلکہ اس ہائی کورٹ کے ججز قصور وار ہیں۔ کیا مجھ سمیت سب کے خلاف انکوائری شروع کی جائے؟ اس کا کیا مطلب ہے؟
وکیل لطیف آفریدی نے کہا کہ ان کے موکل کا کہنا ہے کہ وہ بیان حلفی کے متن سے متفق ہیں جو شائع کیا گیا ہے۔
اسلام آباد ہائی کورٹ نے اہم فیصلہ سناتے ہوئے کہا کہ اگر پیر تک بیان حلفی جمع نہ کرایا گیا تو ملزمان پر فرد جرم عائد کی جائے گی۔ عدالت نے کیس کی سماعت پیر تک ملتوی کر دی۔
واضح رہے کہ اخبار میں خبر شائع ہونے کے بعد عدالت نے توہین عدالت کی کارروائی شروع کردی ہے۔ عدالت نے 30 نومبر کو رانا شمیم کو شوکاز نوٹس کا چار دن میں جواب داخل کرنے اور برطانیہ سے اصل بیان حلفی جمع کرانے کا حکم دیا تھا۔ رانا شمیم نے شوکاز نوٹس کا جواب جمع کرایا لیکن اصل بیان حلفی جمع نہیں کرایا۔
